Jaswant Singh was key BJP man though not mass leader
Janata Party (BJP) Wednesday, was a key member of the party's core decision-making group though never a mass leader.
During his six-year stint in the government, he experienced both highs and lows. The acme of his achievement was his exhaustive rounds of a dialogue that he as external affairs minister minister held with Strobe Talbott, his counterpart in the US administration, following the 1998 Indian nuclear test.
They met as many as 14 times in seven countries between June 1998 and September 2000. These talks have been widely acknowledged by present US Secretary of State Hillary Clinton as having laid the groundwork for the eventual transformation of Indo-US ties.
The low point in his ministerial career was when he led Pakistani terrorists to freedom in Kandahar in Afghanistan in December 1999 after the hijack of flight IC-814 by Islamists.

Capital’s swine flu tally at 251
Students bore the brunt of infection again, with many schools fumigating classrooms, canteens, common rooms and buses over the weekend to allay parents’ fears.
“On Saturday, 23 cases were confirmed, which included the 14 new cases. Reports of 16 suspected cases admitted in hospitals across the Capital are awaited,” said Delhi Health Minister Kiran Walia.
The minister added that all positive cases had been quarantined at home and health officers were tracking people who have come in contact with them.
“We are doing our best to contain it, but its spread is inevitable,” said Walia.
Only one of the 13 cases reported was an infection acquired abroad.
“When the World Health Organisation declared H1N1 a pandemic, they indicated containment was not possible. We are now focusing on damage reduction,” said a senior Delhi government official, tracking cases in the Capital who is not authorised to speak to the media.
Students from Sanskriti School , Mt Carmel, Delhi Public School, Mathura Road, Mother’s International, CRPF Prashant Vihar and Vishwa Bharti Public School were among the eight students tested positive on Saturday.
Sanskriti School in south Delhi’s Chanakyapuri confirmed three swine flu cases, of which one was a Class VIII student back from a camp in England. The other two students are in Classes IV and XI, who attended school till Thursday.
“Today, we learnt of three students who have contracted the virus. In the UK case, we are not really worried as the student had not rejoined school yet,” said Abha Sahgal, principal, Sanskriti School.
The case reported from Sanskriti on Thursday tested negative. “We had the school fumigated on Friday,” Sahgal added. The school is now closed for all of next week.
With schools being closed for the weekend, schools had a difficult time identifying students who could have contracted the virus.
“There is no way for us for us to find out who could be infected as the school is closed for the weekend. We’ll get a clear picture only on Monday," said M.I. Husain, principal, DPS Mathura Road.

SAIL Q1 net falls; dramatic demand rise unlikely
The state-run firm, which has the largest steel making capacity within India, plans to borrow 40 billion to 50 billion rupees ($830 million-$1 billion) this fiscal year to meet its capex plans, Chairman S.K. Roongta said, adding that additional equity issue was also another option the company was looking at.
"We are considering that," Roongta said of the additional equity issue, without giving details.
The steel industry, recognised as a broad gauge of an economy's strength, has globally seen demand tumble, driven by the weakness in key automotive and construction sectors.
"We must reckon the fact that even now globally capacity utilisation is quite low. As the demand picks up, there is enough capacity," Steel Authority's Roongta said.
"We are not going to see any situation where demand will be more than supply."
Prices are, however, not under pressure, he said.
Steel Authority's production and sales in the July month is up about 10 percent from a year ago and it will try to maintain the trend for the quarter ending September, Roongta said.
He expects raw material prices to be sequentially lower in the September quarter.
Indian Oil net surges 780 percent
The company reported a net profit of Rs.3,680 crore ($763 million) for the quarter compared to Rs.410 crore in the like period the year before.
The total income for the same period stood at Rs.60,680 crore, down from Rs.89,140 crore a year earlier.
This year's first quarter figures also include the numbers for Bongaigaon Refinery and Petrochemicals Ltd (BRPL), which was merged with India Oil March 25, 2009.
The gross refining margin has seen a decline from $16.81 per barrel to $7.36 per barrel during the first quarter.
Indian Oil got discounts worth Rs.229 crore from upstream companies for the April-June quarter as compared to Rs.6,230 crore a year ago.

INDIAN REAL ESTATE INVESTORS GOING GLOBAL

Companies investing abroad
Globalization which is a much abused term these days means Indian companies entering into joint ventures with foreign companies. It also means exporting goods and services to foreign countries. The core issue in the definition of globalization is that the companies have to go global to advertise themselves. In the present set up it can be noticed that there are already several players in the global market but Indian companies are still lagging behind. The reasons for this are manifold. Firstly, the Government has not encouraged Indian companies to step into the global market. Secondly, the Indian real estate companies are caught up with the domestic work. And finally, some of the companies who tried to invest abroad were at a loss due to lack of guidance, support and knowledge.
But now the Indian government seems to have realized the fact that investing abroad is necessary for a company's extension and escalation. This is the reason it has allowed companies to freely invest up to $ 15 million without taking any permission from RBI. In addition to this fast track clearances of $ 4 million are given for investments abroad.
According to the Liberalized Overseas Investment Guidelines, companies have also been given permission to invest a maximum of 50 per cent of GDR’s abroad.
Guidelines for investors
As we can see that India is gradually turning towards becoming an investment hub in real estate, the Indians who are keen on investing abroad should weigh their returns and compare them with India first. Ideally an Indian should buy property abroad only if the returns are much higher as compared to those in India.

EC decision on RS bypolls challenged
The Sena feels the decision of a separate election to every seat will give Congress-NCP mileage to corner all three seats as they outnumber the Sena-BJP in terms of arithmetic in the 288-member state assembly. Whereas, if the elections for all three seats take place together the Sena-BJP together can muster more than 100 MLAs' support to win one seat out of the three. The Sena suspects political motive behind such a move to favour the Congress-NCP.
The by-elections for RS is necessitated following vacancies after union civil aviation minister Praful Patel, Supriya Sule (NCP) and Mukul Wasnik (Congress) shifted to Lok Sabha from the RS after the parliament polls.
The notification for the RS by-polls is likely to be issued on Thursday coinciding with the hearing in the apex court on the petition filed by Sena candidate Rahul Narwekar.
Narwekar has stated: "The three vacancies are from the same category as the term of all three seats will expire on the same day April 2, 2012. Therefore, three vacancies should be filled by holding one election." It also emphasises how in the past the Election Commission has conducted one elections to fill these three seats in 2006."
According to the petition, "If separate elections are conducted it will defeat the objective of article 80(4) Constitution of India which advocates representation of every group in RS shall be in accordance to the strength of representation in their respective state legislation. It means proportionate representation."
SC allows raped ‘child’ to give birth
The three-judge bench headed by Chief Justice K.G. Balakrishnan brushed aside every argument in favour of aborting the foetus, adopting a pro-life stand in a courtroom packed with activists, foreign journalists and young lawyers eager to gauge the outcome of the controversial case that is certain to generate in India a debate usually seen in the West.
“We are not in favour of termination of pregnancy,” the bench said, as it “stayed” a Punjab and Haryana High Court order.
The lower court had directed termination of the pregnancy, now in its 19th week, based on reports of an expert committee of doctors.
Under Indian law, medical termination of pregnancy is prohibited after the 20th week, though an appeal for a review of the 1971 act is pending before the Supreme Court.
In this case, the matter reached the apex court because the girl wanted to keep the baby but the Chandigarh administration was against it and the high court directed immediate termination.
The apex court acknowledged that time was “very less” for the 19-year-old, raped by two security guards at a home run by the Chandigarh administration, but took note of the statement of doctors that the woman had to be under constant supervision.
HC reserves NTPC-RIL gas dispute order
However, NTPC argued that the amendments suggested by RIL were not in contention to the case and that they were aware of the eGoM decisions as per its minutes of September 12, which was prior to commencement of trial. Moreover, eGoM minutes state that it is subject to RIL-NTPC suit and hence the amendments should not be allowed.
RIL counsel argued that their stand has always been that the contract between the companies was not a concluded one. He also stated that if the plea is not amended RIL’s rights will be affected but if the amendment is allowed NTPC’s rights do not get affected. RIL also pointed out that NTPC was a government nominee as per article 21(6) and that the amendment was sought as Union of India Affidavit in the RIL-RNRL case on January 13, states that the decision on price as per eGoM meeting September 12, 2007 will be applicable to all sectors.
This point was also raised by additional solicitor general in the RIL-RNRL case where he reiterated that NTPC is a government nominee and will take supply of gas as per the decisions of the government on parametres of price, quantity and tenure based on the utilisation policy. The division bench comprising Chief Justice Swatanter Kumar and Justice Khanwalkar have reserved their order on the amendment of the plea sought by RIL.
It must be mentioned here that the RIL-NTPC case relates to whether there is a binding nature of contract between NTPC and RIL. NTPC claims that based on a conditional acceptance of the letter of intent, the contract has been concluded and RIL should be directed to supply gas. On the other hand, RIL argues that the final contract has not been concluded as issues like “unlimited liability” on supply of alternate fuels and reserving gas for use had not been settled. NTPC filed suit in Bombay High Court on December 20, 2005, while discussions between were still on. NTPC stated the terms were binding on RIL as letter...
HDFC net up 21%; to raise Rs 4k crore
it announced a 21% rise in first quarter profits and spoke about a resurgence in housing demand.
Shareholders of India’s top mortgage lender approved the qualified institutional placement (QIP) of non-convertible debentures with warrants, which allow its holders to buy shares in the future, at the firm’s annual meeting.
HDFC chairman Deepak Parekh said that the strike price for the warrants would be at a premium to present market levels.
Mr Parekh, who has run HDFC for nearly three decades and is set to become non-executive chairman after relinquishing executive duties at the end of 2009, told shareholders that there would not be any bonus issues until 2012-13 — making it 10 years after the last bonus issue.
However, he assured shareholders that the company would consider preferential allotment of shares in HDFC Standard Life to HDFC shareholders whenever the insurance firm chose to go public.
HDFC reported a net profit of Rs 564.92 cr for the quarter to end- June, up from Rs 468 in the year earlier period. Although profits improved, HDFC’s net interest margins declined slightly, falling to 2.19% for the quarter from 2.21% in FY09 and 2.32% the year before.
Mr Parekh said that margins in the earlier years were flattered by cheaper cost of funds thanks to the preferential allotment of shares to Carlyle and Citigroup, which raised Rs 3114cr raised in May 2007.
The HDFC chief also said that there was a resurgence in demand for housing, which was preventing property rates from falling while increasing loan growth.
HDFC approved loans worth Rs 12,259 cr during the quarter, up 23% year-on-year, while disbursals grew 21% to Rs 8,688 cr. Compared with the preceding quarter – the last quarter of the previous fiscal year – HDFC’s loan approvals and disbursements grew 45% and 19% respectively.
Responding to a query on outlook for interest rates Mr Parekh said “With the increased government borrowing, going forward everyone expects interest rates to rise. But for the the present there is ample liquidity and interest rates are soft” said Parekh.
Shares in HDFC closed 4.43% down at Rs 2,410.30 on Wednesday amid concerns of the expected equity dilution as a result of its proposed fund raising.
One analyst at a private bank, who did not wish to be named, said that there were concerns that the Rs 4,000cr QIP issue which could expand the com-pany’s equity base by 3.5% would put further pressure on margins. “The money will be used to buy shares of HDFC Bank, which will not earn as much income as say lending for home loans.”

Declare Ambani MoU illegal, govt asks SC
The government today joined the dispute that has simmered between Mukesh and Anil Ambani since 2006 over gas from the Krishna-Godavari basin when it filed a special leave petition (SLP) in the Supreme Court pleading that the memorandum of understanding between the two brothers be treated “illegal” and declared null and void as it treated the gas as a personal and family property of the signatories.
Anil Ambani-promoted Reliance Natural Resources Ltd (RNRL) has laid claim (through a family agreement prior to the group’s split in 2005) to 28 million standard cubic metres a day (mscmd) of gas from Mukesh Ambani’s Reliance Industries Ltd (RIL) at a price of $2.34 per million metric British thermal units (mmBtu) for 17 years.

Refund Rs 600 cr: Maytas to Satyam
In a surefire indicator that Maytas and Satyam are headed on a collision course, the government-controlled Maytas Infra board has declared that Rs 380 crore worth of inter-corporate deposits (ICDs) had found their way to Satyam accounts.
What’s more, another Rs 220 crore is learnt to have wound its way into Satyam accounts from Maytas Properties. Now both these companies are seeking a refund from Satyam, in which Tech Mahindra has recently upped its stake to 42.7%.
Divulging this on Saturday after the Matyas Infra board meeting here, Ved Jain, government-appointed director on board of both Maytas Infra and Maytas Properties, said: “We have found that the entire ICDs of Rs 380 crore have gone out of Maytas Infra to 14 or 15 Maytas Infra-controlled private companies and from there to Satyam bank accounts. Another Rs 220 crore from Maytas Properties has gone into Satyam accounts.”
Selja seeks amendment to town planning
New Delhi (PTI): Seeking reservation of land for affordable housing and survey of all slums in cities across India, the Centre has asked all state governments and Union Territories to amend town planning and other related laws for this.
In a letter written to all chief ministers, Housing and Urban Poverty Alleviation Minister Kumari Selja has sought the amendment to town planning for reservation of land for affordable housing.
"You may kindly consider amending town planning, urban area development, municipal and other related laws to provide for reservation of land for affordable housing, basic amenities and informal sector activities of the poor," Ms. Selja stated in her letter.

KARACHI (AFP) — Pakistan's cricket chief on Wednesday denied boycotting a meeting in India that handed the country's World Cup 2011 matches to co-hosts and called again for talks on winning back the fixtures.
The Central Organising Committee (COC) of the World Cup 2011 met in Mumbai on Tuesday and redistributed the 14 matches originally given to Pakistan. Eight went to India, four to Sri Lanka and two to Bangladesh.
Pakistan, which was stripped of its matches by the International Cricket Council (ICC) in April over security fears, was invited to the meeting as the fourth co-host but no Pakistan Cricket Board (PCB) representative attended.
PCB chairman Ijaz Butt denied Pakistan had refused to go to the event.
Air India Asked To Mull Plane Orders
NEW DELHI -- India's federal government has asked loss-making national carrier Air India to start talks with Boeing Co. and Airbus to restructure its orders for 111 planes, an Air India executive said Wednesday.
"The (Air India) management was told in the last board meeting to look at options of both deferring and canceling future aircraft deliveries," Jitendra Bhargava, executive director for corporate communications at Air India, told Dow Jones Newswires.
"We have been told to get back to the government with the legal implications. There has been no decision by the company taken yet," said Mr. Bhargava.
Air India ordered a combined 111 planes from Boeing and Airbus, valued at an estimated $15 billion at list prices. The carrier has already received 50 planes from the two aircraft manufacturers.

The London Evening Standard reports on the ripple effect from the Rio Tinto decision to outsource legal work last May.
The Evening Standard spoke with Soumitro Chatterjee, head of outsourcing for India's largest law firm, FoxMandal Little, who believes that "more than 3,000 corporate lawyers and administration staff in cities such as Mumbai and Delhi [will be] going on the pay roll of City firms and British companies by the start of next year. Mr Chatterjee said he had met representatives from 10 City firms in recent weeks - each looking to outsource up to 100 legal jobs." In other words, up to another 1,000 legal jobs are set to move from London to India this year.
Major UK firms such as, Allen & Overy, Clifford Chance, Eversheds, Lovells, as well as Simmons and Simmons have already been sending work to India and South Africa.
